第8条 戦争犯罪 ―Article 8 War crimes

1　裁判所は、戦争犯罪、特に、計画若しくは政策の一部として又は大規模に行われたそのような犯罪の一部として行われるものについて管轄権を有する。
2　この規程の適用上、「戦争犯罪」とは、次の行為をいう。

　(a)千九百四十九年八月十二日のジュネ-ヴ諸条約に対する重大な違反行為、すなわち、関連するジュネ-ヴ条約に基づいて保護される人又は財産に対して行われる次のいずれかの行為
　　(i)　殺人
　　(ii)　拷問又は非人道的な待遇(生物学的な実験を含む。)
　　(iii)　身体又は健康に対して故意に重い苦痛を与え、又は重大な傷害を加えること。
　　(iv)　軍事上の必要性によって正当化されない不法かつ窓意的に行う財産の広範な破壊又は徴発
　　(v)　捕虜その他の被保護者を強制して敵国の軍隊において服務させること。
　　(vi)　捕虜その他の被保護者からの公正な正式の裁判を受ける権利のはく奪
　　(vii)　不法な追放、移送又は拘禁
　　(viii)　人質をとること。
　(b)　確立された国際法の枠組みにおいて国際的な武力紛争の際に適用される法規及び慣例に対するその他の著しい違反、すなわち、次のいずれかの行為
　　(i)　文民たる住民それ自体又は敵対行為に直接参加していない個々の文民を故意に攻撃すること。
　　(ii)　民用物、すなわち、軍事目標以外の物を故意に攻撃すること.
　　(iii)　国際連合憲章の下での人道的援助又は平和維持活動に係る要員、施設、物品、組織又は車両であって、武力紛争に関する国際法の下で文民又は民用物に与えられる保護を受ける権利を有するものを故意に攻撃すること。
　　(iv)　予期される具体的かつ直接的な軍事的利益全体との比較において、攻撃が、巻き添えによる文民の死亡若しくは傷害、民用物の損傷又は自然環境に対する広範、長期的かつ深刻な損害であって、明らかに過度となり得るものを引き起こすことを認識しながら故意に攻撃すること。
　　(v)　手段のいかんを問わず、防衛されておらず、かつ、軍事目標でない都市、町村、住居又は建物を攻撃し、又は砲撃し若しくは爆撃すること。.
　　(vi)　武器を放棄して又は防衛の手段をもはや持たずに自ら投降した戦闘員を殺害し、又は負傷させること。
　　(vii)　ジュネ-ヴ諸条約に定める特殊標章のほか、休戦旗又は敵国若しくは国際連合の旗若しくは軍隊の記章及び制服を不適正に使用して、死亡又は重傷の結果をもたらすこと。
　　(viii)　占領国が、その占領地域に自国の文民たる住民の一部を直接若しくは間接に移送すること又はその占領地域の住民の全部若しくは一部を当該占頒地域の内において若しくはその外に追放し若しくは移送すること。
　　(ix)　宗教、教育、芸術、科学又は慈善のために供される建物、歴史的建造物、病院及び傷病者の収容所であって、軍事目標以外のものを故意に攻撃すること。
　　(x)　敵対する紛争当事国の権力内にある者に対し、身体の切断又はあらゆる種類の医学的若しくは科学的な実験であって、その者の医療上正当と認められるものでも、その者の利益のために行われるものでもなく、かつ、その者を死に至らしめ、又はその健康に重大な危険が生ずるものを受けさせること。
　　(xi)　敵対する紛争当事国又は軍隊に属する個人を背信的に殺害し、又は負傷させること。
　　(xii)　助命しないことを宣言すること。
　　(xiii)　敵対する紛争当事国の財産を破壊し、又は押収すること。ただし、戦争の必要性から絶対的にその破壊又は押収を必要とする場合は、この限りでない。
　　(xiv)　敵対する紛争当事国の国民の権利及び訴権が消滅したこと、停止したこと又は裁判所において受理されないことを宣言すること。

　　(x)　敵対する紛争当事国の権力内にある者に対し、身体の切断又はあらゆる種類の医学的若しくは科学的な実験であって、その者の医療上正当と認められるものでも、その者の利益のために行われるものでもなく、かつ、その者を死に至らしめ、又はその健康に重大な危険が生ずるものを受けさせること。
　　(xi)　敵対する紛争当事国又は軍隊に属する個人を背信的に殺害し、又は負傷させること。
　　(xii)　助命しないことを宣言すること。
　　(xiii)　敵対する紛争当事国の財産を破壊し、又は押収すること。ただし、戦争の必要性から絶対的にその破壊又は押収を必要とする場合は、この限りでない。
　　(xiv)　敵対する紛争当事国の国民の権利及び訴権が消滅したこと、停止したこと又は裁判所において受理されないことを宣言すること。
　　(xv)　敵対する紛争当事国の国民が戦争の開始前に本国の軍役に服していたか否かを問わず、当該国民に対し、その本国に対する軍事行動への参加を強制すること。
　　(xvi)　襲撃により占領した場合であるか否かを問わず、都市その他の地域において略奪を行うこと。
　　(xvii)　毒物又は毒を施した兵器を使用すること。
　　(xviii)　窒息性ガス、毒性ガス又はこれらに類するガス及びこれらと類似のすべての液体、物質又は考案物を使用すること。
　　(xix)　人体内において容易に展開し、又は扇平となる弾丸(例えば、外包が硬い弾丸であって、その外包が弾芯を全面的には被覆しておらず、又はその外包に切込みが施されたもの)を使用すること。
　　(xx)　武力紛争に関する国際法に違反して、その性質上過度の傷害若しくは無用の苦痛を与え、又は本質的に無差別な兵器、投射物及び物質並びに戦闘の方法を用いること。ただし、これらの兵器、投射物及び物質並びに戦闘の方法が、包括的な禁止の対象とされ、かつ、第百二十一条及び第百二十三条の関連する規定に基づく改正によってこの規程の附属書に含められることを条件とする。
　　(xxi)　個人の尊厳を侵害すること(特に、侮辱的で体面を汚す待遇)。
　　(xxii)　強姦、性的な奴隷、強制売春、前条２(f)に定義する強いられた妊娠状態の継続、強制断種その他あらゆる形態の性的暴力であって、ジュネ-ヴ諸条約に対する重大な違反行為を構成するものを行うこと。
　　(xxiii)　文民その他の被保護者の存在を、特定の地点、地域又は軍隊が軍事行動の対象とならないようにするために利用すること。
　　(xxiv)　ジュネーヴ諸条約に定める特殊標章を国際法に従って使用している建物、物品、医療組織、医療用輸送手段及び要員を故意に攻撃すること。
　　(xxv)　戦闘の方法として、文民からその生存に不可欠な物品をはく奪すること(ジュネ-ヴ諸条約に規定する救済品の分配を故意に妨げることを含む。)　によって生ずる飢餓の状態を故意に利用すること。
　　(xxvi)　十五歳未満の児童を自国の軍隊に強制的に徴集し若しくは志願に基づいて編入すること又は敵対行為に積極的に参加させるために使用すること。
　(c)　国際的性質を有しない武力紛争の場合には、千九百四十九年八月十二日のジュネ-ヴ諸条約のそれぞれの第三条に共通して規定する著しい違反、すなわち、敵対行為に直接に参加しない者　(武器を放棄した軍隊の構成員及び病気、負傷、抑留その他の事由により戦闘能力のない者を含む。)　に対する次のいずれかの行為
　　(i)　生命及び身体に対し害を加えること(特に、あらゆる種類の殺人、身体の切断、虐待及び拷問)。
　　(ii)　個人の尊厳を侵害すること(特に、侮辱的で体面を汚す待遇)。
　　(iii)　人質をとること。
　　(iv)　一般に不可欠と認められるすべての裁判上の保障を与える正規に構成された裁判所の宣告する判決によることなく刑を言い渡し、及び執行すること。
　(d)　(c)の規定は、国際的性質を有しない武力紛争について適用するものとし、暴動、独立の又は散発的な暴力行為その他これらに類する性質の行為等国内における騒乱及び緊張の事態については、適用しない。
　(e)　確立された国際法の枠組みにおいて国際的性質を有しない武力紛争の際に適用される法規及び慣例に対するその他の著しい違反、すなわち、次のいずれかの行為
　　(i)　文民たる住民それ自体又は敵対行為に直接参加していない個々の文民を故意に攻撃すること。
　　(ii)　ジュネ-ヴ諸条約に定める特殊標章を国際法に従って使用している建物、物品、医療組織、医療用輸送手段及び要員を故意に攻撃すること。
　　(iii)　国際連合憲章の下での人道的援助又は平和維持活動に係る要員、施設、物品、組織又は車両であって、武力紛争に関する国際法の下で文民又は民用物に与えられる保護を受ける権利を有するものを故意に攻撃すること。
　　(iv)　宗教、教育、芸術、科学又は慈善のために供される建物、歴史的建造物、病院及び傷病者の収容所であって、軍事目標以外のものを故意に攻撃すること。
　　(v)　襲撃により占領した場合であるか否かを問わず、都市その他の地域において略奪を行うこと。
　　(vi)　強姦、性的な奴隷、強制売春、前条２(f)に定義する強いられた妊娠状態の継続、強制断種その他あらゆる形態の性的暴力であって、ジュネ-ヴ諸条約のそれぞれの第三条に共通して規定する著しい違反を構成するものを行うこと。
　　(vii)　十五歳未満の児童を軍隊若しくは武装集団に強制的に徴集し若しくは志願に基づいて編入すること又は敵対行為に積極的に参加させるために使用すること。
　　(viii)　紛争に関連する理由で文民たる住民の移動を命ずること.ただし、その文民の安全又は絶対的な軍事上の理由のために必要とされる場合は、この限りでない。
　　(ix)　敵対する紛争当事者の戦闘員を背信的に殺害し、又は負傷させること。
　　(x)　助命しないことを宣言すること。
　　(xi)　敵対する紛争当事者の権力内にある者に対し、身体の切断又はあらゆる種類の医学的若しくは科学的な実験であって、その者の医療上正当と認められるものでも、その者の利益のために行われるものでもなく、かつ、その者を死に至らしめ、又はその健康に重大な危険が生ずるものを受けさせること。
　　(xii)　敵対する紛争当事者の財産を破壊し、又は押収すること。ただし、紛争の必要性から絶対的にその破壊又は押収を必要とする場合は、この限りでない。
　(f)　(e)の規定は、国際的性質を有しない武力紛争について適用するものとし、暴動、独立の又は散発的な暴力行為その他これらに類する性質の行為等国内における騒乱及び緊張の事態については、適用しない。同規定は、政府当局と組織された武装集団との間又はそのような集団相互の間の長期化した武力紛争がある場合において、国の領域内で生ずるそのような武力紛争について適用する。

3　2(c)及び(e)の規定は、あらゆる正当な手段によって、国内の法及び秩序を維持し若しくは回復し、又は国の統一を維持し、及び領土を保全するための政府の責任に影響を及ぼすものではない。

1. The Court shall have jurisdiction in respect of war crimes in particular when committed as part of a plan or policy or as part of a large-scale commission of such crimes.

2. For the purpose of this Statute, "war crimes" means:

(a) Grave breaches of the Geneva Conventions of 12 August 1949, namely, any of the following acts against persons or property protected under the provisions of the relevant Geneva Convention:

(i) Wilful killing;

(ii) Torture or inhuman treatment, including biological experiments;

(iii) Wilfully causing great suffering, or serious injury to body or health;

(iv) Extensive destruction and appropriation of property, not justified by military necessity and carried out unlawfully and wantonly;

(v) Compelling a prisoner of war or other protected person to serve in the forces of a hostile Power;

(vi) Wilfully depriving a prisoner of war or other protected person of the rights of fair and regular trial;

(vii) Unlawful deportation or transfer or unlawful confinement;

(viii) Taking of hostages.

(b) Other serious violations of the laws and customs applicable in international armed conflict, within the established framework of international law, namely, any of the following acts:

(i) Intentionally directing attacks against the civilian population as such or against individual civilians not taking direct part in hostilities;

(ii) Intentionally directing attacks against civilian objects, that is, objects which are not military objectives;

(iii) Intentionally directing attacks against personnel, installations, material, units or vehicles involved in a humanitarian assistance or peacekeeping mission in accordance with the Charter of the United Nations, as long as they are entitled to the protection given to civilians or civilian objects under the international law of armed conflict;

(iv) Intentionally launching an attack in the knowledge that such attack will cause incidental loss of life or injury to civilians or damage to civilian objects or widespread, long-term and severe damage to the natural environment which would be clearly excessive in relation to the concrete and direct overall military advantage anticipated;

(v) Attacking or bombarding, by whatever means, towns, villages, dwellings or buildings which are undefended and which are not military objectives;

(vi) Killing or wounding a combatant who, having laid down his arms or having no longer means of defence, has surrendered at discretion;

(vii) Making improper use of a flag of truce, of the flag or of the military insignia and uniform of the enemy or of the United Nations, as well as of the distinctive emblems of the Geneva Conventions, resulting in death or serious personal injury;

(viii) The transfer, directly or indirectly, by the Occupying Power of parts of its own civilian population into the territory it occupies, or the deportation or transfer of all or parts of the population of the occupied territory within or outside this territory;

(ix) Intentionally directing attacks against buildings dedicated to religion, education, art, science or charitable purposes, historic monuments, hospitals and places where the sick and wounded are collected, provided they are not military objectives;

(x) Subjecting persons who are in the power of an adverse party to physical mutilation or to medical or scientific experiments of any kind which are neither justified by the medical, dental or hospital treatment of the person concerned nor carried out in his or her interest, and which cause death to or seriously endanger the health of such person or persons;

(xi) Killing or wounding treacherously individuals belonging to the hostile nation or army;

(xii) Declaring that no quarter will be given;

(xiii) Destroying or seizing the enemy's property unless such destruction or seizure be imperatively demanded by the necessities of war;

(xiv) Declaring abolished, suspended or inadmissible in a court of law the rights and actions of the nationals of the hostile party;

(xv) Compelling the nationals of the hostile party to take part in the operations of war directed against their own country, even if they were in the belligerent's service before the commencement of the war;

(xvi) Pillaging a town or place, even when taken by assault;

(xvii) Employing poison or poisoned weapons;

(xviii) Employing asphyxiating, poisonous or other gases, and all analogous liquids, materials or devices;

(xix) Employing bullets which expand or flatten easily in the human body, such as bullets with a hard envelope which does not entirely cover the core or is pierced with incisions;

(xx) Employing weapons, projectiles and material and methods of warfare which are of a nature to cause superfluous injury or unnecessary suffering or which are inherently indiscriminate in violation of the international law of armed conflict, provided that such weapons, projectiles and material and methods of warfare are the subject of a comprehensive prohibition and are included in an annex to this Statute, by an amendment in accordance with the relevant provisions set forth in articles 121 and 123;

(xxi) Committing outrages upon personal dignity, in particular humiliating and degrading treatment;

(xxii) Committing rape, sexual slavery, enforced prostitution, forced pregnancy, as defined in article 7, paragraph 2 (f), enforced sterilization, or any other form of sexual violence also constituting a grave breach of the Geneva Conventions;

(xxiii) Utilizing the presence of a civilian or other protected person to render certain points, areas or military forces immune from military operations;

(xxiv) Intentionally directing attacks against buildings, material, medical units and transport, and personnel using the distinctive emblems of the Geneva Conventions in conformity with international law;

(xxv) Intentionally using starvation of civilians as a method of warfare by depriving them of objects indispensable to their survival, including wilfully impeding relief supplies as provided for under the Geneva Conventions;

(xxvi) Conscripting or enlisting children under the age of fifteen years into the national armed forces or using them to participate actively in hostilities.

(c) In the case of an armed conflict not of an international character, serious violations of article 3 common to the four Geneva Conventions of 12 August 1949, namely, any of the following acts committed against persons taking no active part in the hostilities, including members of armed forces who have laid down their arms and those placed hors de combat by sickness, wounds, detention or any other cause:

(i) Violence to life and person, in particular murder of all kinds, mutilation, cruel treatment and torture;

(ii) Committing outrages upon personal dignity, in particular humiliating and degrading treatment;

(iii) Taking of hostages;

(iv) The passing of sentences and the carrying out of executions without previous judgement pronounced by a regularly constituted court, affording all judicial guarantees which are generally recognized as indispensable.

(d) Paragraph 2 (c) applies to armed conflicts not of an international character and thus does not apply to situations of internal disturbances and tensions, such as riots, isolated and sporadic acts of violence or other acts of a similar nature.
(e) Other serious violations of the laws and customs applicable in armed conflicts not of an international character, within the established framework of international law, namely, any of the following acts:

(i) Intentionally directing attacks against the civilian population as such or against individual civilians not taking direct part in hostilities;

(ii) Intentionally directing attacks against buildings, material, medical units and transport, and personnel using the distinctive emblems of the Geneva Conventions in conformity with international law;

(iii) Intentionally directing attacks against personnel, installations, material, units or vehicles involved in a humanitarian assistance or peacekeeping mission in accordance with the Charter of the United Nations, as long as they are entitled to the protection given to civilians or civilian objects under the international law of armed conflict;

(iv) Intentionally directing attacks against buildings dedicated to religion, education, art, science or charitable purposes, historic monuments, hospitals and places where the sick and wounded are collected, provided they are not military objectives;

(v) Pillaging a town or place, even when taken by assault;

(vi) Committing rape, sexual slavery, enforced prostitution, forced pregnancy, as defined in article 7, paragraph 2 (f), enforced sterilization, and any other form of sexual violence also constituting a serious violation of article 3 common to the four Geneva Conventions;

(vii) Conscripting or enlisting children under the age of fifteen years into armed forces or groups or using them to participate actively in hostilities;

(viii) Ordering the displacement of the civilian population for reasons related to the conflict, unless the security of the civilians involved or imperative military reasons so demand;

(ix) Killing or wounding treacherously a combatant adversary;

(x) Declaring that no quarter will be given;

(xi) Subjecting persons who are in the power of another party to the conflict to physical mutilation or to medical or scientific experiments of any kind which are neither justified by the medical, dental or hospital treatment of the person concerned nor carried out in his or her interest, and which cause death to or seriously endanger the health of such person or persons;

(xii) Destroying or seizing the property of an adversary unless such destruction or seizure be imperatively demanded by the necessities of the conflict;

(f) Paragraph 2 (e) applies to armed conflicts not of an international character and thus does not apply to situations of internal disturbances and tensions, such as riots, isolated and sporadic acts of violence or other acts of a similar nature. It applies to armed conflicts that take place in the territory of a State when there is protracted armed conflict between governmental authorities and organized armed groups or between such groups.

3. Nothing in paragraph 2 (c) and (e) shall affect the responsibility of a Government to maintain or re-establish law and order in the State or to defend the unity and territorial integrity of the State, by all legitimate means.

　①　本裁判所は、特に計画もしくは政策の一部として行なわれた戦争犯罪またはこのような犯罪の大規模な実行の一部として行なわれた戦争犯罪に関して、裁判権を有する。
　②　本規程の目的に関して、 「戦争犯罪」とは次のことを意味する。
　　a　1949年8月12日のジュネーブ諸条約の重大な違反、すなわち、当該ジュネーブ条約の規定で保護される人または財産に対する次に掲げる行為のいずれか。
　　 i　 故意による殺害
　 　ii　生物学的実験を含む捜問または非人道的な取扱い
　　 iii　身体または健康に対して故意によって重大な苦痛を引き起こしまたは重大な傷害を与えること
　　 iv　軍事的必要性によっては正当化されず、かつ、不法に悪意的に実行された財産の広範な破壊および領得
　　　v　捕虜またはその他保護された人を敵対する当事国の軍隊において強制的に使役すること
　　　vi　捕虜またはその他保護された人から公正かつ適法な裁判を受ける権利を故意に奪うこと
　　　vii　違法な追放もしくは移送または違法な監禁
　　　viii　人質にとること
　　b　国際法の確立した枠組みの中における、国際武力紛争に適用される法規および慣例のその他の重大な違反、すなわち、次に掲げる行為のいずれか。
　　 i　一般住民または敵対行為に直接参加していない民間の個人に対する意図して攻撃を加えること
　　 ii　民用物すなわち軍事目標ではない目的物に対して意図して攻撃を加えること
　　 iii　国際連合憲章に則り人道的援助または平和維持活動に関与する人員、施設、物資、部隊または車輌であって、武力紛争に関する国際法において民間人または民用物に対して与えられる保護に値するものに対して意図して攻撃を加えること
　　 iv　攻撃が、予期された具体的かつ直接的な軍事的利便に照らして明らかに過剰となる、民間人の生命の損失もしくは負傷または民用物への損書もしくは自然環境に対する長期的重大な損害を付随的に含むことを知りながら、攻撃を意図的に行なうこと
　　　v　手段のいかんを問わず、無防備で、かつ、軍事目標となっていない都市、村落、居住地または建物に対する攻撃または爆撃
　　　vi　武器を放棄しまたはもはや防御手段をもたずに、任意に降伏した戦闘員の殺害または傷害
　　　vii 休戦旗、敵国または国際連合の旗または軍章もしくは制服またはジュネーブ諸条約の特定の徽章を不正に使用することによって、人の死または重大な身体傷害を生じさせること
　　　viii　占領軍によってその占領する地域に自国の民間人の一部を直接もしくは間接に移転させ、または被占領地域の住民の全部もしくは一部をその被占領地域の内もしくは外に強制移送もしくは移転させること
　　 ix　宗教、教育、芸術、科学もしくは慈善の目的に使われる建物、歴史的遺跡、病院並びに病者および傷者を集合させている場所に対して意図して攻撃を加えること。ただし、これらのものが軍事目標でない場合に限る。
　　 x　関係人の医療、歯科治療もしくは療養によっては正当化されず、かつ、その人の利益のために行なわれたのではないものであって、かつ、これらの人の死もしくは重大な健康への危険を生じさせる、身体の切断または医学的もしくは科学的な実験に、敵対する権力の掌中にある人を従わせること
　　　xi　敵国または敵軍に属する人を、偽計をもって、殺害または傷害すること
　　　xii　助命をいっさい与えないと告げること
　　　xiii　戦争の必要からやむを得ない場合を除き、敵側の財産を破壊または接収すること
　　　xiv　敵対する当事国の国民の権利および訴訟活動について、裁判所においてその失効、停止または許容性の欠如を宣告すること
　　　xv　戦争の開始前に交戦者としての役務に従事していた場合であっても、敵対する当事国の国民を自国に対する戦争の作戦行動に強制して参加させること
　　　xvi　急襲した場合であっても、都市または場所を略奪すること
　　　xvii　毒または毒性のある兵器を使用すること
　　　xviii　窒息性ガス、毒ガスまたはその他のガスおよび類似の液体、物資または装置を使用すること
　　 xix　中心部を全面的には覆っていない硬性の莢もしくは切開されて孔を空けられた硬性の莢をもつ弾丸など、人体内において容易に拡大またはつぶれる弾丸を使用すること
　　　xx　過剰な傷害もしくは不必要な苦痛を生じさせる性質を帯び、または武力紛争に関する国際法に違反してそもそも無差別的な性質を帯びた兵器、投擲物および物質ならびに戦闘手段を使用すること。ただし、このような兵器、投擲物および物資ならびに戦闘手段が包括的な禁止の対象となり、かつ、第121条および第123条に定める関連規定に即して修正された本規程の附則に含まれるものであることを要する。
　　　xxi　人格の尊厳を侵害すること、特に、侮辱的で体面を汚す取扱いを行なうこと
　　　xxii　第7条第2項第f号に定める強かん、性的奴隷化、強制売春、強制妊娠、強制不妊手術またはその他ジュネーブ諸条約の重大な違反となる性的暴力をすること
　　　xxiii　一定の地点、地域または軍隊を軍事作戦行動の対象とされることを免れるため、民間人またはその他の被保護者を利用すること
　　 xxiv　国際法に則りジュネーブ諸条約の特定の徽章を用いる建物、資材、医療品および運送ならびに人員に対して意図して攻撃を加えること
　　　xxv　ジュネーブ諸条約に則り供与された救援の提供を、故意をもって妨害することを含む、民間人からその生存に不可欠な物を奪うことによって戦闘の手段として民間人の飢餓を意図して利用すること
　　　xxvi 15歳未満の子どもを国内の軍隊に徴用もしくは募集しまたは敵対行為に積極的に参加させるために15歳末満の子どもを利用すること
　c　国際的な性格をもたない武力紛争の場合において、1949年8月12日のジュネーブ4条約共通第3条の重大な違反であって、武器を放棄した軍隊の構成員および病気、負傷、抑留その他の事由により戦闘外に置かれた人を含む、敵対行為に直接に参加しない人に対して行なわれた次に掲げる行為のいずれか。
　 i　生命および身体に対する暴行、特に、あらゆる種類の殺人、傷害、虐待および拷問
　　 ii　個人の尊厳に対する侵害、特に、侮辱的で体面を汚す取扱い
　　 iii　人質をとること
　　 iv　正規に構成された裁判所で一般に不可欠と認めるすべての裁判上の保障を与えた上であらかじめなされる裁判によらない判決の言渡しおよび刑の執行
　d　第2項第c号の規定は、国際的な性格をもたない武力紛争に適用され、それゆえ、内乱などの国内での紛擾および緊張状態、関連性のない突発的な暴力またはその他の同様の性質を有する行為に適用されない。
　e　国際的な性格をもたない武力紛争に適用されるその他の法規および慣例の重大な違反であって、確立した国際法の枠組みの中にあるもの、すなわち、次に掲げる行為のいずれか。
　　i　一般住民または敵対行為に直接参加していない民間人に対して意図して攻撃を加えること
　　ii　国際法に則りジュネーブ諸条約の特定の徽章を用いる建物、資材、医療品および運送ならびに人員に対して意図して攻撃を加えること
　　iii　国際連合憲章に則り人道的援助または平和維持活動に関与する人員、施設、物資、部隊または車輌であって、武力紡争に関する国際法において民間人または民用物に対する保護に値するものに対して意図して攻撃を加えること
　　 iv　宗教、教育、芸術、科学もしくは慈善の目的に使われる建物、歴史的遺跡、病院ならびに病者および傷者を集合させている場所に対して意図して攻撃を加えること。ただし、これらのものが軍事目標でない場合に限る。
　　　v　急襲した場合であっても、都市または場所を略奪すること
　　　vi　第7条第2項第f号に定める強かん、性的奴隷化、強制売春、強制妊娠、強制不妊手術またはその他ジュネーブ諸条約の重大な違反となる性的暴力をすること
　　　vii 15歳未満の子どもを軍隊または集団に徴用もしくは募集し、または敵対行為に積極的に参加させるために15歳末満の子どもを利用すること
　　 viii　当該民間人の安全またはやむを得ない軍事上の必要がないのに、紛争に関係した理由によって、一般住民の移住を命令すること
　　 ix　敵側戦闘員を、偽計をもって、殺害または傷害すること
　　　x　助命をいっさい与えないと告げること
　　　xi　関係人の医療、歯科治療もしくは療養によっては正当化されず、かつ、その人の利益のために行なわれたのではないものであって、かつ、これらの人の死もしくは重大な健康への危険を生じさせる、身体の切断まだは医学的もしくは科学的な実験に、敵対する権力の掌中にある人を従わせること
　　　xii　紛争の必要からやむを得をない場合を除き、敵側の財産を破壊または接収すること
　 f　本条第2項第e号は、国際的な性格をもたない武力紛争に適用し、それゆえ暴動、単発的および散発的な暴力またはその他の類似の性質をもつ行為など、国内的な騒動および緊張の事態には適用しない。政府機関と組織された武力集団との間または組織された武力集団の間において武力紛争が長期化している場合には、国の領域内で生じる武力紛争にも適用する。
　③　本条第2項第c号および第d号のいずれも、あらゆる正当な手段によって、自国において法と秩序を維持しもしくは再建し、または国家の統一および領域保全を守る政府の費任に影響を与えるものではない。
