第7条 人道に対する犯罪 ―Article 7 Crimes against humanity
1 この規程の適用上、「人道に対する犯罪」とは、文民たる住民に対する攻撃であって広範又は組織的なものの一部として、そのような攻撃であると認識しつつ行う次のいずれかの行為をいう。
(a) 殺人
(b) 絶滅させる行為
(c) 奴隷化すること。
(d) 住民の追放又は強制移送
(e) 国際法の基本的な規則に違反する拘禁その他の身体的な自由の著しいはく奪
(f) 拷問
(g) 強姦、性的な奴隷、強制売春、強いられた妊娠状態の継続、強制断種その他あらゆる形態の性的暴力であってこれらと同等の重大性を有するもの
(h) 政治的、人種的、国民的、民族的、文化的又は宗教的な理由、3に定義する性に係る理由その他国際法の下で許容されないことが普遍的に認められている理由に基づく特定の集団又は共同体に対する迫害であって、この1に掲げる行為又は裁判所の管轄権の範囲内にある犯罪を伴うもの
(j) 人の強制失踪
(j) アパルトヘイト犯罪
その他の同様の性質を有する非人道的な行為であって、身体又は心身の健康に対して故意に重い苦痛を与え、又は重大な傷害を加えるもの
2 1の規定の適用上、
(a) 「文民たる住民に対する攻撃」とは、そのような攻撃を行うとの国若しくは組織の政策に従い又は当該政策を推進するため、文民たる住民に対して１に掲げる行為を多重的に行うことを含む一連の行為をいう。
(b) 「絶滅させる行為」には、住民の一部の破壊をもたらすことを意図した生活条件を故意に課すること（特に食糧及び薬剤の入手の機会のはく奪） を含む。
(c) 「奴隷化すること」とは、人に対して所有権に伴ういずれか又はすべての権限を行使することをいい、人 (特に女性及び児童) の取引の過程でそのような権限を行使することを含む。
(d) 「住民の追放又は強制移送」とは、国際法の下で許容されている理由によることなく、退去その他の強制的な行為により、合法的に所在する地域から関係する住民を強制的に移動させることをいう。
(e) 「拷問」とは、身体的なものであるか精神的なものであるかを問わず、抑留されている者又は支配下にある者に著しい苦痛を故意に与えることをいう。ただし、拷問には、専ら合法的な制裁に固有の又はこれに付随する苦痛が生ずることを含まない。
(f) 「強いられた妊娠状態の継続」とは、住民の民族的な組成に影響を与えること又は国際法に対するその他の重大な違反を行うことを意図して、強制的に妊娠させられた女性を不法に監禁することをいう。
この定義は、妊娠に関する国内法に影響を及ぼすものと解してはならない。
(g) 「迫害」とは、集団又は共同体の同l性を理由として、国際法に違反して基本的な権利を意図的にかつ著しくはく奪することをいう。
(h) 「アパルトヘイト犯罪」とは、1に掲げる行為と同様な性質を有する非人道的な行為であって、一の人種的集団が他の一以上の人種的集団を組織的に抑圧し、及び支配する制度化された体制との関連にお いて、かつ、当該体制を維持する意図をもって行うものをいう。
(i) 「人の強制失綜」とは、国若しくは政治的組織又はこれらによる許可、支援若しくは黙認を得た者が、長期間法律の保護の下から排除する意図をもって、人を逮捕し、拘禁し、又は泣致する行為であって、その自由をはく奪していることを認めず、又はその消息若しくは所在に関する情報の提供を拒否することを伴うものをいう。
3 この規程の適用上、「性」とは、社会の文脈における両性、すなわち、男性及び女性をいう。「性」の語は、これと異なるいかなる意味も示すものではない。
1. For the purpose of this Statute, "crime against humanity" means any of the following acts when committed as part of a widespread or systematic attack directed against any civilian population, with knowledge of the attack:
(a) Murder;
(b) Extermination;
(c) Enslavement;
(d) Deportation or forcible transfer of population;
(e) Imprisonment or other severe deprivation of physical liberty in violation of fundamental rules of international law;
(f) Torture;
(g) Rape, sexual slavery, enforced prostitution, forced pregnancy, enforced sterilization, or any other form of sexual violence of comparable gravity;
(h) Persecution against any identifiable group or collectivity on political, racial, national, ethnic, cultural, religious, gender as defined in paragraph 3, or other grounds that are universally recognized as impermissible under international law, in connection with any act referred to in this paragraph or any crime within the jurisdiction of the Court;
(i) Enforced disappearance of persons;
(j) The crime of apartheid;
(k) Other inhumane acts of a similar character intentionally causing great suffering, or serious injury to body or to mental or physical health.
2. For the purpose of paragraph 1:
(a) "Attack directed against any civilian population" means a course of conduct involving the multiple commission of acts referred to in paragraph 1 against any civilian population, pursuant to or in furtherance of a State or organizational policy to commit such attack;
(b) "Extermination" includes the intentional infliction of conditions of life, inter alia the deprivation of access to food and medicine, calculated to bring about the destruction of part of a population;
(c) "Enslavement" means the exercise of any or all of the powers attaching to the right of ownership over a person and includes the exercise of such power in the course of trafficking in persons, in particular women and children;
(d) "Deportation or forcible transfer of population" means forced displacement of the persons concerned by expulsion or other coercive acts from the area in which they are lawfully present, without grounds permitted under international law;
(e) "Torture" means the intentional infliction of severe pain or suffering, whether physical or mental, upon a person in the custody or under the control of the accused; except that torture shall not include pain or suffering arising only from, inherent in or incidental to, lawful sanctions;
(f) "Forced pregnancy" means the unlawful confinement of a woman forcibly made pregnant, with the intent of affecting the ethnic composition of any population or carrying out other grave violations of international law. This definition shall not in any way be interpreted as affecting national laws relating to pregnancy;(g) "Persecution" means the intentional and severe deprivation of fundamental rights contrary to international law by reason of the identity of the group or collectivity;
(h) "The crime of apartheid" means inhumane acts of a character similar to those referred to in paragraph 1, committed in the context of an institutionalized regime of systematic oppression and domination by one racial group over any other racial group or groups and committed with the intention of maintaining that regime;
(i) "Enforced disappearance of persons" means the arrest, detention or abduction of persons by, or with the authorization, support or acquiescence of, a State or a political organization, followed by a refusal to acknowledge that deprivation of freedom or to give information on the fate or whereabouts of those persons, with the intention of removing them from the protection of the law for a prolonged period of time.
3. For the purpose of this Statute, it is understood that the term "gender" refers to the two sexes, male and female, within the context of society. The term "gender" does not indicate any meaning different from the above.
? 本規程の目的に関して、「人道に対する罪とは、一般住民に向けられた広範な攻撃または系統的な攻撃の一環として、この攻撃を知りながら行なった次に掲げる行為のいずれかを意味する。

e 国際法の基本原則に違反する投獄また は身体の自由の著しい剥奪
f 拷問
g 強かん、性的奴隷化、強制売春、強制妊娠、強制断種またはその他同等の重大な性的暴力
h 第3項に定める政治、人種、国民、民族、文化、宗教、性別に基づき、またはその他国際法において許容されないものとして普遍的に認められた理由に基づき、本項に掲げる行為に関連して、または本裁判所の管轄権に属するいずれかの犯罪に関連して、いずれかの同一視しうる集団に対して行なわれる迫害または集団的に行なわれる迫害
i 強制失踪
j アパルトヘイト罪
k 意図的に、著しい苦痛を与え、身体もしくは心身の健康に重大な害をもたらす同様の性質をもつその他の非人間的な行為
? 本項の目的に関して、
a 「いずれかの一般住民に向けられた攻撃」とは、このような攻撃を行なうための国家もしくは組織の政策に従って、またはこのような攻撃を行なう国家もしくは組織の政策を維持するために、いずれかの一般住民に対する第1項に掲げる行為を多数行なうことを含む一連の行動を意味する。
b 「せん滅」とは、食料および医薬品を入手する方法を奪うなど、住民の一部を破壊することを計算に入れた生活条件を意図して押しつけることを含む。
c 「奴隷化」とは、人に対する所有の権利に連なるいずれかの権限またはそのすべての権限の行使を意味し、かつ、女性および子どもなど、人身の取引にあたってこのような権限を行使することを含む。
d 「住民の追放または強制移転」とは、国際法に従って許容される理由がないのに、排除またはその他の強制的行動によって、住民を、その合法的に所在する場所から強制的に移動させることを意味する。
e 「拷問」とは、拘禁された人または被疑者被告人として管理されている人に対して、身体的であると精神的であるとを問わず、著しい苦痛または苦しみを意図して与えることを意味する。ただし、拷問は、合法的な制裁からのみ生じ、または合法的な制裁に内在的に含まれもしくはこれに付随して生じる苦痛または苦しみを含まない。
f 「強制妊娠」とは、いずれかの住民の民族的構成に影響を与え、またはその他国際法の重大な違反を行なう意図をもって、強制的に妊娠させられた女性の違法な監禁を意味する。
g 「迫害」とは、集団の同一性のゆえにまたは集国的に、国際法に違反して、基本的権利を意図的かつ著しく奪うことを意味する。
h 「アパルトヘイト罪」とは、ある人種集団の他の人種集団または諸集団に対する系統的な弾圧および支配の制度化した体制の文脈の中において行なわれ、かつ、この体制を維持する意図をもって行なわれた、第1項に掲げる行為と同等の性格をもつ非人間的な行為を意味する。
i 「強制失踪」とは、国家もしくは政治的組織によって、または国家もしくは政治組織の許可、支援もしくは黙認によって、人の逮捕、拘禁または拉致をすることであって、これに続き、長期的な期間についてこの人に対する法の保護を取り去る意図をもって、このような自由の剥奪の事実を認めることを拒み、またはこの人の生死または所在に関する情報の提供を拒むことを意味する。
? 本規程の目的に関して、 「性別」という用語は社会の文脈における男性および女性の両性を指すものと理解される。 「性別」という用語は、これ以外にいかなる意味ももたない。
