第98条 免責の放棄および引渡しへの同意に関する協力 ― Article 98 Cooperation with respect to waiver of immunity and consent to surrender

　①　本裁判所は、要請を受けた国に対し、国際法に基づくその国の義務または第三国の人もしくは財産の外交官免責と両立しない行為を求めることになる引渡しまたは援助の要請を行なうことはできない。ただし、本裁判所が外交官免責の放棄についてその第三国の協力をあらかじめ得ることができる場合はこの限りでない。
　②　本裁判所は、要請を受けた国に対し、引渡国の人を本裁判所に引き渡すためにその国の同意を必要とする国際条約がある場合、これに基づくその国の義務と両立しない行為を求めることになる引渡しの要請を行なうことができない。ただし、本裁判所が引渡しについてその引渡国の協力をあらかじめ得ることができる場合はこの限りでない。

1. The Court may not proceed with a request for surrender or assistance which would require the requested State to act inconsistently with its obligations under international law with respect to the State or diplomatic immunity of a person or property of a third State, unless the Court can first obtain the cooperation of that third State for the waiver of the immunity.

2. The Court may not proceed with a request for surrender which would require the requested State to act inconsistently with its obligations under international agreements pursuant to which the consent of a sending State is required to surrender a person of that State to the Court, unless the Court can first obtain the cooperation of the sending State for the giving of consent for the surrender.
